Terms of Service

These Terms of Service ("Terms") govern your access to and use of thedcworker.com (the "Site") and any services offered by TheDCworker ("TheDCworker," "we," "us," or "our"), including website design and development, website management and maintenance, WordPress support, speed optimization, security updates, social media management, content scheduling, graphic design, and Google Analytics/SEO services (collectively, the "Services"). By visiting the Site, submitting an inquiry, booking a call, or engaging us for Services, you ("Client," "you") agree to be bound by these Terms. If you do not agree, please do not use the Site or engage our Services.
1. Who We Are
TheDCworker provides website design, development, management, and social media management services to small businesses and individuals. You can reach us at thedcworker@gmail.com, via WhatsApp or Messenger from the Site, or by booking a call through our Calendly link.
2. Proposals, Quotes & Scope of Work
Pricing shown on the Site (including on our Pricing page) is indicative and may vary based on your specific requirements. A project begins only once a proposal, quote, or scope of work has been agreed and any required deposit has been received.
- The scope of a project is defined by the package or proposal you accept. Work outside that scope (e.g., additional pages, features, or functionality) is billed separately as an add-on or change order.
- A feature or change requested after the scope has been approved may require an additional charge, which we will quote before proceeding.
- Delivery timelines listed on the Site are estimates and depend on timely feedback and content from you.
3. Payment Terms
Unless otherwise agreed in writing, projects are billed in stages based on total project price:
- Projects under $500: 50% deposit, 50% due before launch.
- Projects between $500 and $1,500: 40% deposit, 30% at midpoint, 30% before launch.
- Projects over $1,500: 40% deposit, 30%, 20%, and 10%, staged across the project timeline.
Monthly plans (website management and social media management) are billed in advance on a recurring monthly basis and are month-to-month with no long-term contract — you may cancel at any time effective at the end of the current billing period. Fees already paid are non-refundable Late or missed payments may result in a pause of work or suspension of active plans until payment is received.
4. Revisions & Additional Work
Each package includes a set number of revision rounds, as described in the applicable proposal or pricing plan. Additional revision rounds beyond what is included are billed at our then-current add-on rate.
5. Client Content & Responsibilities
You are responsible for providing accurate, complete, and lawful text, images, logos, branding, and business information needed to complete your project, unless content creation was purchased separately as an add-on. Delays in providing content may delay delivery timelines. You represent that any content you provide does not infringe the intellectual property, privacy, or other rights of any third party, and you agree to indemnify us against claims arising from content you supply.
6. Intellectual Property
Upon receipt of full payment, you will own the final website design and content created specifically for your project, excluding third-party elements such as licensed stock photography, fonts, plugins, themes, or software, which remain subject to their own licenses. Until full payment is received, all work product remains the property of TheDCworker. We reserve the right to display completed work in our portfolio and marketing materials unless you request otherwise in writing.
7. Hosting, Domains & Third-Party Services
Hosting and domain registration costs are separate from our fees unless explicitly included in your proposal. Payment processors, plugins, themes, and other third-party subscriptions required for your project are billed separately and are subject to the terms of those third-party providers. We are not responsible for outages, price changes, or policy changes by third-party providers (e.g., hosting companies, payment gateways, WordPress plugin developers).
8. Website Management & Maintenance Plans
Monthly management and maintenance plans include a defined amount of work time per month, as described in the applicable plan (e.g., monitoring, backups, minor content updates, security updates). Unused hours do not roll over to the following month. Work requests beyond the plan's included hours are billed separately or scheduled for the next billing cycle.
9. Social Media Management
Social media management plans include a defined number of posts, graphics, captions, and scheduling per month, as described in the applicable plan. We manage content on your behalf but are not responsible for the policies, algorithm changes, outages, or account actions taken by third-party social media platforms (e.g., Facebook, Instagram). You are responsible for maintaining ownership and administrative access to your own social media accounts.
10. Communications
By contacting us via WhatsApp, Messenger, the chat widget on our Site, or email, you consent to receiving replies through that same channel for the purpose of responding to your inquiry or providing Services. We do not sell or share your contact information with third parties for their own marketing purposes.
11. Disclaimers
Services are provided on an "as is" and "as available" basis. While we take reasonable care in design, development, security, and optimization work, we do not guarantee specific results such as search engine rankings, traffic levels, conversion rates, or social media growth, as these depend on factors outside our control.
12. Limitation of Liability
To the fullest extent permitted by law, TheDCworker's total liability arising out of or relating to the Services shall not exceed the total amount paid by you for the specific Service giving rise to the claim in the three (3) months preceding the claim. We are not liable for indirect, incidental, special, or consequential damages, including loss of profits, data, or business opportunity.
13. Termination
Either party may terminate a monthly plan at any time, effective at the end of the current billing period, by notifying the other in writing (including via email or WhatsApp). For project-based work, either party may terminate with written notice; you remain responsible for payment for work completed up to the date of termination, and any deposit paid is non-refundable.
14. Changes to These Terms
We may update these Terms from time to time. Changes will be posted on this page with an updated effective date. Continued use of the Site or Services after changes are posted constitutes acceptance of the revised Terms.
15. Governing Law
These Terms are governed by the laws of the Republic of the Philippines, without regard to conflict-of-law principles, unless otherwise agreed in writing for a specific engagement.
